Florida Month-to-Month Lease Agreement

The Florida Month-to-Month Lease Agreement is a document used for the renting a property or unit in short-term increments of thirty (30) days. The lease type is often used by property owners and landlords who cannot sign a full-year lease for a rental, allowing them to legally evict tenants with a notice of only fifteen (15) days (prior to the end of the lease). On the other hand, the lease type is preferred by tenants looking for an extended vacation, a temporary work position, or those unsure of the length in which they will need to rent.

State Laws

Statute: § 83.57

Required Notice to Terminate: Per state law, landlords and tenants have to provide the following amount of notice prior to terminating their lease (depending on the timeframe of the agreement):

  1. Year to year tenancy: Sixty (60) days’ notice prior to the end of any annual term.
  2. Quarter to quarter: Thirty (30) days’ notice prior to the end of the quarterly term.
  3. Month to month: Fifteen (15) days’ notice prior to the end of the monthly term.
  4. Week to week: Seven (7) days’ notice prior to the end of the weekly term.
